The rights of air passengers in case of flight cancellation within the European Union are governed by Regulation (EC) No. 261/2004. Here is a list of the main rights of passengers in case of cancellation:

  • Right to Information

Airlines must inform passengers of cancellations and their rights to reimbursement, rerouting, and assistance.

  • Right to Assistance

In case of flight cancellation, passengers are entitled to assistance while waiting for rerouting. This includes meals and drinks proportional to the waiting time, two phone calls, fax or email messages, and, if necessary, accommodation in a hotel and transport between the airport and the place of lodging.

  • Refund or Rerouting

Refund: Passengers are entitled to a full refund of the ticket cost for the unused part or parts of the journey, and for the parts already completed if the flight no longer serves the original purpose of the trip, within seven days. This may also include a return flight to the first point of departure as soon as possible.

Rerouting : Passengers can choose to be rebooked on another flight to their final destination as soon as possible or on a later date at their convenience, subject to seat availability.

  • Right to Compensation

Passengers may be entitled to compensation ranging from 250€ to 600€, depending on the flight distance and the notice given regarding the cancellation. Compensation is not due if the cancellation is caused by extraordinary circumstances that could not have been avoided even if all reasonable measures had been taken, or if the passenger was informed of the cancellation at least two weeks before the scheduled departure date. The compensation may be reduced by 50% if the rerouting offered allows arrival at the destination with minimal delay compared to the originally scheduled arrival time.

Always remember that requesting a refund for a canceled flight does not obligate you to give up the compensation you may be entitled to under EU Regulation (EC) No. 261/2004. These two rights serve different purposes and can be claimed independently under certain conditions.

What does Refund mean?

If your flight has been canceled, you have the right to request a full refund of the ticket for the part or parts of the journey not completed and for the parts already completed if the flight no longer serves the original purpose of the trip. This may also include a return flight to the first point of departure as soon as possible.

What does Compensation mean?

In addition to the refund, you may be entitled to compensation if the flight cancellation occurs without adequate notice and is not caused by extraordinary circumstances that could not have been avoided even if all reasonable measures had been taken. Compensation ranges from 250€ to 600€, depending on the distance of the flight and the specific circumstances of the cancellation.

The right to compensation is independent from ticket reimbursement.
Receiving a ticket refund does not automatically exclude the possibility of also receiving compensation, unless you specifically accept a form of compensation that explicitly excludes it (for example, some vouchers or benefits offered by the airline may have terms that preclude further compensation claims).

If you believe you are entitled to both a refund and compensation, it's important to clearly communicate this to the airline when making your request. If you encounter difficulties with the airline or feel that your rights have not been respected, you can contact the relevant national authority in the EU country where the incident occurred or in the EU country where your flight departed for assistance and guidance on how to proceed.

If the airline does not provide the assistance measures stipulated by EU Regulation (EC) No. 261/2004 in case of flight cancellation, such as meals, beverages, two phone calls, accommodation in a hotel, and transportation, here's what you can do:

  • Document the lack of assistance.

Keep all receipts and documentation related to expenses incurred for meals, drinks, calls, accommodation, and transportation that should have been provided by the airline. This will be crucial for any refund claim.

  • Make a direct request to the airline.

Contact the airline directly, providing specific details of your cancelled flight and a list of the unprovided assistance. Attach all receipts of the incurred expenses. Specify that you are requesting reimbursement for these expenses as per Regulation (EC) No. 261/2004.

  • Submit an official complaint

If the airline does not respond or refuses your refund, you can file a complaint with the relevant national authority in the EU country where the incident occurred or in the EU country of departure. This authority can assess your case and, if necessary, intervene

It's important to act promptly and provide all necessary evidence to support your claim. Understanding your rights and having accurate documentation are crucial to ensuring the airline fulfills its obligations.

Frequently Asked Questions about refund and compensation
for delayed or cancelled flights

You are entitled to compensation for a cancelled flight under Regulation EC 261/2004 when your flight departs from the EU or the United Kingdom with any airline, or arrives in the EU with a European airline. Compensation is due if you were not informed of the cancellation at least 14 days before departure, or if the cancellation was not caused by extraordinary circumstances such as severe weather, public health emergencies, or air traffic control strikes.

Compensation for a cancelled flight depends on the distance of the flight:
  • €250 for flights up to 1,500 km
  • €400 for flights between 1,500 km and 3,500 km
  • €600 for flights over 3,500 km
These amounts are per passenger and independent of the ticket price. Compensation can reach up to €600 per passenger.

Extraordinary circumstances that exclude the right to compensation include:
  • Severe weather conditions that make flying impossible
  • Public health or security emergencies
  • Strikes by air traffic control staff or airport personnel external to the airline
  • Political instability or security risks
Note: Strikes by the airline's own staff are not considered extraordinary circumstances.

If your flight is cancelled, you have the right to:
  • Information about the cancellation and your rights
  • Choice between a full refund of the ticket within seven days or rerouting to your final destination
  • Assistance with meals, drinks, and two communications
  • Hotel accommodation and airport-hotel transport if an overnight stay is necessary
  • Financial compensation between €250 and €600 if you were not informed at least 14 days in advance

If you are informed of the cancellation less than 14 days before departure, you are entitled to financial compensation. The amount may be reduced by 50% if you are offered an alternative flight that allows you to arrive at your destination with minimal delay compared to the original schedule. If you are informed less than 7 days in advance, you are always entitled to full compensation.

Yes. Under Regulation EC 261/2004, the rights to compensation and refund are separate. The refund covers the cost of the unused portion of your ticket, while compensation is an additional financial payment of €250 to €600 for the inconvenience suffered. You may claim both if you are eligible.

A refund is the right to receive the full cost of your ticket within seven days for the unused part(s) of the journey, and for the parts already completed if the flight no longer serves its original purpose—along with, if necessary, a return flight to the first point of departure as soon as possible.

Rerouting is the right to be rebooked to your final destination as soon as possible or at a later date that suits you, subject to seat availability. While waiting, you are entitled to meals, drinks, communications, hotel accommodation, and transport between the airport and the hotel if needed.

You can claim compensation within the statutory limitation period, which is generally three years from the date of the flight. It is important to keep all documents: ticket, boarding pass, airline notifications about the cancellation, and proof of any expenses incurred.

The process is simple and fast in 3 steps:
  1. Submit your claim: it takes just 2 minutes to check the compensation amount and send your request
  2. ReFly works for you: the legal team will negotiate with the airlines and authorities on your behalf
  3. Receive your compensation: once the case is won, the money will be deposited into your bank account
You pay nothing unless you win! ReFly covers all costs and has a 98% success rate.
